House Rules

This English version is provided for information only. In case of any discrepancy, the Portuguese version (Regulamento Interno) prevails.

Any situation that may arise and is not specifically covered by these rules will be governed by the general civil, labour and criminal law in force.

Article 1 (Brand and Responsible Entity)

Mind & Body Fitness, Lda., company no. 517887053, registered office at Rua Manuel Ferreira, n.º 23 D, 2795-229 Linda-a-Velha, Portugal, is the entity responsible for managing and running the BloomFit brand and studio. Its business activities are gym (fitness) and sports and recreational teaching; professional training; and studio rental.

Article 2 (Application)

These house rules apply immediately to all clients, staff and other users of the studio. They are displayed in the studio for consultation and remain in force indefinitely, and may be changed at any time by the responsible entity. They are also available at www.bloomfit.pt.

Article 3 (Services)

When purchasing the chosen service, the client must fill in a registration form (online link) and pay for the personal accident insurance. The client is responsible for the accuracy of all the information given in the registration form. If personal details need to be confirmed, Mind & Body Fitness, Lda. may ask the client for identification.

A medical certificate confirming fitness for physical exercise is recommended. A signed statement of responsibility for taking part in physical and sports activity is mandatory.

At the time of purchase, the client must pay the amounts due for the chosen service. Joining the mandatory personal sports accident insurance held by the studio is also compulsory.

The service can be cancelled at any time by writing to bloomfit.geral@gmail.com at least 30 days before the next scheduled renewal. Cancellation does not entitle the client to a refund of any amounts already paid.

If the client does not use all the sessions included in the chosen service, they do not carry over to the next period and no amount paid for them will be refunded.

Article 4 (Personal Accident Insurance)

The physical safety of studio clients must be covered by personal accident insurance, without which they may not use the facilities (Decree-Law 385/99 of 28 September, Article 13). This insurance is annual and must be renewed on its expiry date at the displayed price.

In the event of an accident, the insured person must pay the €50 excess. Mind & Body Fitness, Lda. will fill in the relevant form and send it to the insurer to open the claim. The injured person may be treated wherever they choose and submit the expenses to the insurer. They must then send the insurer all the clinical information/medical report and the invoices, together with proof of their IBAN, so that the insurer can make the refund by bank transfer. The insurer deducts the excess from the payment. Amounts paid are limited to the insured amount for treatment expenses, as defined by law.

The client acknowledges and accepts that sports insurance is not included in trial classes or one-off events open to participants from outside the studio. By choosing to take part in these activities, the participant takes full responsibility for their participation.

Article 5 (Group Classes | Small Group and Payments)

In accordance with Article 3, the client chooses the desired service and pays according to the current price list, plus the annual insurance. Services purchased and payments made are personal and may not be transferred to third parties, except in exceptional cases approved by the management.

The first payment can be made using the methods offered by BloomFit. To keep the service running and hold the client's place, direct debit must then be set up. After signing up, the client must send proof of their IBAN to bloomfit.geral@gmail.com so that the direct debit can be activated.

Direct debit is the payment method used by BloomFit for services with automatic renewal and a permanently reserved place. The client undertakes to keep their bank details up to date and to ensure there are sufficient funds for the amounts due.

A returned or rejected payment may lead to the temporary suspension of the client's place until the situation is resolved, as well as an administrative fee of €5 to cover the costs of handling and processing it.

Cancelling the direct debit at the bank does not cancel the membership; the cancellation periods and conditions set out in these rules still apply. For cancellation to take effect, it must be sent in writing to bloomfit.geral@gmail.com and is then processed by BloomFit in the app.

Prices shown include VAT at the applicable legal rate. BloomFit may run temporary promotional campaigns, which do not need to be included in these rules. Prices may be updated by the management with at least 30 days' notice before they take effect. Discounts and campaigns cannot be combined with other current promotions unless expressly stated otherwise.

Class times are chosen by the client when signing up. Clients with an active direct debit have their place permanently reserved at the contracted times. Clients with packs are subject to the places available in each class, with no guaranteed time or fixed place.

Class times must be respected. The instructor may refuse entry to the class if the client is more than 10 minutes late.

Article 6 (Training and Conduct)

Studio users are responsible for using the equipment properly and putting it away. All clients must bring a training towel and use it in the studio, for their own hygiene and that of the equipment.

Class start times must be respected, and the instructor reserves the right to refuse entry once the class has started, so as not to disturb the other members.

Smoking is not allowed in the studio.

Clients must behave appropriately towards staff, instructors and each other, and take care of the equipment. Inappropriate or offensive behaviour and language will not be tolerated in the studio; in case of breach, the client may be asked to leave the premises or, ultimately, the contract may be terminated for just cause.

Article 7 (Service Details, Bookings and Cancellations)

Consultations

This service includes nutrition consultations (online) and trial assessment, personal training and small group sessions. Times will be arranged according to the availability of the client and of the professionals providing the service. Payment must be made when booking, using the available methods. Cancellations must be made in the app, within the stated notice period. If the cancellation is not made within this period, the session will be considered as given.

Small Group

This service includes different types of training, with duration and goals defined according to each class's programme. All class times are shown on the online timetable and in the app, according to instructor availability.

All clients with an active direct debit are automatically booked into their contracted class times, with their place permanently reserved. Clients with packs must book classes through the online schedule, subject to available places. A permanently reserved place depends on having an active direct debit and payments being up to date. In case of non-payment, BloomFit reserves the right to give the place to another client.

If necessary, class times may change; enrolled clients will be informed by email, through the app or by any other means of communication used by BloomFit.

The number of classes corresponding to the chosen weekly frequency must be used within the 4 weeks of the respective payment cycle (direct debit) or within the 6-week validity of the 4-session packs. Unused classes do not carry over to the next payment cycle.

Payment must be made before the first class, using the payment methods offered by BloomFit.

Missed classes are not made up. Classes must be cancelled through the online schedule, within the period shown in the app. If a class is not cancelled within that period, it will be considered as attended and will not be made up. When a class is cancelled within the set period, the client may rebook it in the same week or the following week, subject to available places. Rebooking must always take place within the respective payment cycle.

Classes on the timetable must have at least 3 clients booked. Running a class with only 2 clients is subject to the management's decision and approval.

On public holidays, class times may be adjusted according to studio opening hours and instructor availability. All affected clients will be informed as early as possible through the app, by email or by other means of communication used by BloomFit. These changes do not give rise to automatic make-up classes.

Small Group payment cycles run in consecutive 4-week periods. In months with more or fewer days, billing dates may not match the start or end of the calendar month, but the number of classes included in the contracted service stays the same.

Summer pause — Exceptionally, during the summer, each client may pause their membership once a year for up to 4 consecutive weeks, keeping their place and their current commercial terms. After this period, the place is no longer guaranteed and BloomFit may give it to another client. Any return will depend on availability and on the commercial terms and prices in force when the membership is reactivated. The pause should be notified to BloomFit at least 15 days in advance whenever possible, so that groups, times and places can be reorganised in good time.

Personal Training

This service includes different types of training based on the client's main individual goals. Times will be arranged according to the availability agreed between the client and the personal trainer.

For direct debits, the sessions must be used within the 4-week period and the amounts shown renew every 4 weeks. For 4-session packs, the sessions must be used within the pack's validity (6 weeks).

Payment must be made before the first session, using the payment methods offered by BloomFit. Sessions are booked with the personal trainer. Cancellations must be made by message or email at least 24 hours before the session. If the cancellation is not made within this period, the session will be considered as given.

Personal Pilates sessions on machines are recommended in a 50-minute format.

Online Programme

This programme gives access to online classes, training plans and recorded classes. All booking and cancellation rules are the same as for Small Group. The Online Programme is included in services costing more than €120.

Events

Registration and confirmation — Registration is only confirmed after payment or prior confirmation, as indicated at the time of booking. By registering, the participant declares that they have read, understood and accept all the conditions set out here.

Minimum number of participants — An event needs at least 4 participants to go ahead. If this minimum is not reached by the set confirmation deadline, the event will be postponed or cancelled.

Refund / rescheduling policy — If the event takes place, no refunds will be given for participants who do not attend. If the event is cancelled or postponed because the minimum number of participants was not reached, registered participants may choose: a) a full refund of the amount paid; or b) to transfer their registration to a future edition of the event, on a date to be agreed (subject to availability).

Confirmation deadline and close of registration — The deadline for confirmation and payment is 24 hours after the registration details are submitted. After that, registrations may be accepted on request, subject to availability.

Cancellation by the participant — Participants who wish to cancel must do so at least 48 hours before the event and may request a refund (or credit for a future event), minus any administrative costs. After that, no refund will be given.

Participation policy — Participation is personal and non-transferable, unless agreed in advance with the organisers. In exceptional cases (unexpected health issues, force majeure), each situation will be assessed individually on presentation of supporting documents.

Organisers' responsibilities — We are committed to providing the best possible service, ensuring logistics, structure and programme as announced. We are not responsible for damage, loss or personal accidents outside the organised activities (e.g. travel arranged by the participant). In case of force majeure (extreme weather, emergencies, legal restrictions), the organisers may take decisions affecting the event, but will always inform participants as early as possible and seek fair solutions.

Image rights — By taking part, the participant authorises the use of photos, videos and materials produced during the event for the organisers' promotional purposes, free of charge. Participants who do not wish to be filmed or photographed must say so in writing before the event starts.

Confidentiality and ethics — Where there are talks, workshops or sensitive exchanges of ideas, participants are expected to respect confidentiality and the agreed code of ethics. Any audio or video recording by participants must be authorised in advance by the organisers.

Special rules (where applicable) — Personal equipment (e.g. sports gear, special clothing) should be used according to the guidance given in advance. Arrival times, breaks, meals and closing will follow the set schedule. In events with physical or trial activities, participants must declare their health conditions and any special conditions or limitations, taking responsibility for their own condition. As these are trial activities, there is no personal accident insurance associated with them. Participants therefore take full responsibility for anything that may happen, including injuries or damage during the class. The organisers may ask for a signed statement of responsibility.

Communication and support — Any questions, enquiries or special requests should be sent to the organisers in advance. The organisers undertake to reply within 2 working days.

Article 8 (Safety and Hygiene)

For safety and hygiene reasons, clients must respect and follow these rules:

Users who, deliberately or through improper use, damage or break any equipment or material will be responsible for its repair or replacement, without prejudice to any other consequences of their actions.

Users are solely responsible for any accidents they suffer in the studio when they use the machines, equipment or changing rooms improperly, without an instructor present, without following their correct use, these rules, the instructions of the duly qualified instructors, or their own natural physical limits.

Article 9 (Opening Hours)

BloomFit is open from 6:00 to 22:00 on weekdays, and from 8:00 to 14:00 on Saturdays, Sundays and public holidays. It is closed on 24, 25 and 31 December and 1 January. All services are by appointment.

Article 10 (Changing Rooms)

Please bring your own padlock. The lockers in the changing rooms are for clients' use, but BloomFit accepts no responsibility for items left in them, including in case of loss or theft. After use, please leave the changing room clean and ready for the next client. BloomFit does not provide towels or personal hygiene products.

Article 12 (Validity and Changes)

These rules take effect on the day after they are displayed in the studio and remain in force indefinitely. Mind & Body Fitness, Lda. reserves the right to change them at any time without prior notice, with changes taking effect from the day after the new rules are displayed; regular reading is therefore recommended.
